These Terms of Use (the "Terms") govern your access to and use of the website at lab33.dev (the "Website"), which is owned and operated by Lab33 Ltd ("Lab33", "we", "us", or "our"), a limited liability company registered in Malta. By accessing or using the Website in any way, you ("you" or "the User") agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not access or use the Website. These Terms do not govern the provision of professional services by Lab33 or the use of the Lab33 OS platform and its products; those are covered by separate agreements.

All content on the Website, including text, graphics, images, icons, logos, illustrations, video, audio, software, code, page layout, and the selection and arrangement of any of the foregoing ("Website Content"), is owned by Lab33 or its licensors and is protected by Maltese, European Union, and international copyright, trademark, and other intellectual property laws.

The Lab33 name, the Lab33 logo, the names Lab33 OS, Contract33, Flow33, Warehouse33, POS33, SIMS33, and APEX33, and any associated logos and trade dress are trademarks of Lab33 Ltd. You may not use any of these marks without our prior written consent.

Subject to these Terms, Lab33 grants you a limited, non-exclusive, non-transferable, revocable licence to access and view the Website for your personal, informational, or legitimate business purposes, such as learning about Lab33, evaluating our products, requesting a quote, or contacting us.

You may display, print, or download individual pages or extracts for your own personal or internal business reference, provided that you do not modify them and that all copyright and other proprietary notices remain intact.

You agree not to use the Website in any way that is unlawful, harmful, or otherwise inconsistent with these Terms. If you submit information to Lab33 through the contact form or by emailing us through the Website (a "Submission"), you warrant that the Submission is accurate, that it does not infringe the rights of any third party, and that you have the right to send it to us.

Submissions are treated in accordance with our Privacy Policy. Lab33 will use Submissions solely to respond to your enquiry and to maintain records of our correspondence, unless you give us explicit consent to use them for another purpose. Lab33 does not claim ownership of Submissions, but by sending us a Submission you grant Lab33 a non-exclusive, royalty-free licence to use, reproduce, and internally store it to the extent necessary to respond to you and to comply with our legal obligations.

Please do not send us any information that is confidential, sensitive, or subject to a duty of confidentiality owed to a third party unless we have agreed in writing to receive it under specific terms.

The Website may contain links to third-party websites, services, or resources that are not owned or controlled by Lab33. We provide these links for convenience only. The inclusion of any link does not imply endorsement by Lab33 of the linked website or any association with its operators. Lab33 has no control over, and accepts no responsibility for, the content, privacy practices, or availability of any third-party website. You agree to indemnify and hold harmless Lab33 and its directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms, your misuse of the Website, or your violation of any law or the rights of any third party.

Lab33 processes personal data in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679), the Maltese Data Protection Act, and any other applicable data protection legislation. How we collect, use, and store personal data that you provide through the Website (for example, via the contact form) is described in our Privacy Policy. Your use of the Website constitutes your acknowledgment of the Privacy Policy.

Lab33 may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and publish the revised version on the Website. Material changes will, where reasonably practical, be highlighted in the updated version. Your continued use of the Website after a revised version has been published constitutes your acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of Malta. Any dispute arising out of or in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts of Malta, without prejudice to the right of Lab33 to seek urgent injunctive or other equitable relief in any court of competent jurisdiction.
